DUI Laws in Colorado

A DUI refers to driving a vehicle while "under the influence" of alcohol and/or drugs. A defendant can be charged with a "DUI per se" for operating a vehicle with a blood alcohol content of .08% or more. In other cases, a defendant might be charged with a DWAI if his or her driving was impaired by the use of alcohol and/or drugs and if his or her BAC is more than .05% but less than .08%.

The penalties for a DUI or DWAI conviction are as follows:

  • 1st offense: 5 days-1 year in jail, $600-$1,000 in fines, 9 months license suspension, 8 months with an ignition interlock device, 48-96 hours of public service (24-48 hours for a DWAI)
  • 2nd offense: 10 days-1 year in jail, $600 to $1,500 in fines, 1 year license suspension if prior conviction was 5 years ago or more recent, 2-5 years with an ignition interlock device, and 48-120 hours of public service
  • 3rd offense: 60 days to 1 year in jail, $600 to $1,500 in fines, license suspended indefinitely, 2-5 years with an ignition interlock device, 48-120 hours of public service
